Terms of Service
Terms of Service
Effective date: 19 April 2026
Last updated: 17 October 2026
1. Agreement to terms
These Terms of Service govern access to and use of Elliott Wave Insight, operated by Anthony Lyle trading as Elliott Wave Insight (“Elliott Wave Insight”, “the business”, “we”, “us” or “our”). By accessing or using the website, content, memberships, community spaces or related services, a user agrees to be bound by these Terms. If these Terms are not accepted, the website and services should not be used.
2. About the service
Elliott Wave Insight provides trading education, analysis, membership content and community access features. The service may include free content, paid memberships, the EWI Trade Journal, MetaTrader software tools, the EW Talk community, updates by email, Telegram or Discord, and other educational or informational resources.
The service is intended for users who can lawfully enter into a contract under applicable law. It is not intended for anyone prohibited from receiving the service by law or by the rules of any third-party platform used to deliver it.
3. Limited licence
Subject to compliance with these Terms, users are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the site and services for personal, lawful and non-commercial use, unless a written agreement says otherwise.
Users must not:
– copy, reproduce, redistribute, sell, licence or exploit site content without permission.
– modify, adapt, translate or create derivative works from the content.
– scrape, crawl, harvest or use automated tools to access the site except where expressly permitted.
– interfere with the security, performance or operation of the site.
– attempt unauthorised access to accounts, systems or networks.
– use the site or community spaces for unlawful, abusive, deceptive or harassing conduct.
– upload malware, spam or other harmful material.
– use the service in any way that breaches applicable law or third-party platform rules.
4. Intellectual property
All text, charts, graphics, videos, analysis, branding, site design and other content available through Elliott Wave Insight are owned by the business or used under licence, unless stated otherwise. All intellectual property rights in the site and content are reserved.
No user acquires ownership rights simply by accessing or paying for the service. Any permission to use content is limited to the licence set out in these Terms or in a separate written licence agreement.
5. Memberships and access
Elliott Wave Insight may offer free and paid memberships, trial periods and community access features. Specific product descriptions, prices and access rights may be displayed on the website or checkout page and form part of the offer at the time of purchase.
5.1 Free membership
A free account may include published analysis on selected markets, the Elliott Wave Academy, the EWI Trade Journal and the Trade Journal EA, and access to community spaces. What is included is shown on the website at the time you register. Free access can be changed, suspended or withdrawn at any time unless a separate written promise says otherwise.
5.2 Paid memberships
Paid memberships may include one or more of the following, depending on the product offered at the time of purchase:
– monthly membership;
– quarterly membership;
– other subscription products or bundles;
– premium analysis, educational resources or live community access.
Where a paid membership is purchased, the user agrees to the billing frequency, price, renewal terms and any stated usage limits shown at checkout or in the product description.
5.3 Trials and introductory offers
Any free trial or introductory offer will end automatically unless the user cancels before the trial ends. If a trial converts into a paid subscription, the billing terms shown at signup apply.
6. Billing, renewal and cancellation
Subscriptions renew automatically until cancelled. Users are responsible for keeping payment details up to date and for ensuring payment methods remain valid.
Cancellation must be made using the methods made available by the business, which may include a dashboard, email or other clear cancellation route. Cancellation stops future renewal charges but does not normally reverse charges already made unless required by law or expressly stated otherwise.
If a consumer has any statutory cooling-off or cancellation rights under applicable law, those rights are not excluded by these Terms and will apply to the extent required by law.
7. Prices and changes
Prices may be changed from time to time. Where required by law or by the relevant subscription terms, reasonable notice will be given before a pricing change takes effect for an existing subscription.
The business may also change the features, access levels or benefits of a membership product, provided any mandatory consumer law obligations are respected and the change is handled fairly.
8. Payments
Payments are processed through Stripe or any other payment provider shown at checkout. Those providers may process card details, billing data and fraud-prevention data as part of payment handling.
The business does not directly store full payment card details on its own systems. Users are responsible for all charges made through their accounts or payment arrangements, subject to any rights they may have under law or under the payment provider’s own process.
9. Refunds
Unless a product page, checkout page or applicable law says otherwise, digital memberships and subscription charges are non-refundable once access has been granted or the subscription has been processed.
This does not affect mandatory consumer rights, including any cooling-off rights that may apply in a particular transaction. Where a refund is required by law, it will be handled in accordance with that law.
10. Community conduct
Users are responsible for the content they post in EW Talk, Telegram, Discord or any other community space associated with the service. Community participation must remain respectful, lawful and relevant to the purpose of the service.
Users must not post:
– unlawful, defamatory or abusive material.
– spam, unsolicited promotion or misleading claims.
– content that infringes copyright, trade marks or other rights.
– harassment, hate speech or threats.
– malicious links, malware or disruptive content.
The business may remove content, limit access, suspend accounts or ban users where it reasonably believes these Terms have been breached or where action is needed to protect the service or its users.
11. Third-party services
The service uses or may use third-party services such as Stripe, Discord, Telegram, MetaTrader and your broker, email infrastructure and analytics tools. Those third parties have their own terms, privacy policies and service rules, and users are responsible for reviewing and complying with them where relevant.
The business is not responsible for outages, changes, restrictions or data handling practices controlled by third-party providers, to the extent permitted by law.
12. Educational and informational disclaimer
The site provides trading education and analysis only. Nothing on the site, in the membership area, in Telegram, in Discord or in any associated communication should be treated as personal investment advice, financial advice, a recommendation to buy or sell any instrument, or a guarantee of future performance.
Trading and financial markets involve substantial risk. Users are solely responsible for their own decisions, risk management and due diligence. Past performance is not a reliable indicator of future results.
13. Availability and changes to the service
The business may update, modify, suspend or discontinue any part of the site or services at any time, including content, features, access routes or community channels. Where reasonably possible, material changes affecting paid members will be communicated in advance.
The business does not guarantee uninterrupted availability, error-free operation or that the service will always be free from defects, delays or technical issues.
14. Liability
Nothing in these Terms limits or excludes liability where doing so would be unlawful. Subject to that, the business will not be liable for indirect, incidental, special, consequential or punitive losses arising from use of the site or services.
To the maximum extent permitted by law, the total liability of the business for any claim arising out of or relating to the service will be limited to the amount paid by the user for the relevant service in the three months before the event giving rise to the claim.
The business is not responsible for third-party content, third-party websites, platform outages, unauthorised access caused by user negligence, or losses caused by events outside its reasonable control.
15. Governing law and disputes
These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over disputes arising from or in connection with these Terms, subject to any mandatory consumer rights that apply.
16. Software, tools and the Trade Journal
16.1 Licence to use our software. Our Expert Advisors, indicators and other trading tools (“the Software”) are licensed to you, not sold. Your licence key is personal to you and covers the MetaTrader accounts stated for it. You must not share, sell or transfer a licence key, or copy, decompile, reverse engineer or remove any protection from the Software. We may suspend or end a licence if these Terms are breached, or when the plan that includes it ends.
16.2 How the Software works. The Trade Journal EA only reads your account and never places, changes or closes a trade. Trading tools such as the Execution Panel and TrendlineTrader place or manage orders only on your instruction and with the settings you choose. You are responsible for those settings, for testing on a demo account first, and for every trade on your account.
16.3 The Trade Journal. Your use of the Trade Journal, including syncing it with the Trade Journal EA or with your MetaTrader investor password, is also governed by the Trade Journal Member Agreement, which you accept before you first use the journal.
16.4 Your broker’s rules. Some brokers and prop firms restrict Expert Advisors, third-party tools or third-party access to accounts. You are responsible for checking that your use of the Software and the Trade Journal is allowed on your account.
16.5 Availability. The Software and syncing depend on MetaTrader, your broker and our servers. They may sometimes be unavailable, delayed or interrupted. Nothing in this section affects your statutory rights for digital content.
